Consumer Health Data Privacy Notice

This Consumer Health Data Privacy Notice (“Notice”) supplements the Clutch Day Privacy Policy and explains how Kelsey Poulter LLC, doing business as Clutch Day (“Clutch Day,” “we,” “us,” or “our”) collects, uses, discloses, and protects Consumer Health Data as defined under the Washington My Health My Data Act and the Nevada Consumer Health Data Privacy Law (“Consumer Health Privacy Laws”).
This Notice applies to residents of Washington or Nevada, or to individuals whose Consumer Health Data is collected in those states through the Clutch Day mobile application and related services (collectively, the “Services”).
This Notice does not apply to employment-related data or information collected from job applicants.
What Is Consumer Health Data
“Consumer Health Data” means personal information that is linked or reasonably linkable to an individual and that identifies past, present, or future physical or mental health status, as defined by applicable Consumer Health Privacy Laws.
Consumer Health Data We Collect
The Consumer Health Data we collect depends on how you use the Clutch Day app and the information you choose to provide.
Examples include:
Body weight and body measurements
Body composition or physique-related inputs
Nutrition-related data (such as intake tracking or dietary preferences)
Training, recovery, and performance-related inputs
Health-adjacent information voluntarily shared through in-app forms or support communications
We do not collect medical diagnoses, clinical test results, genetic data, or information from wearable devices or health platforms such as Apple Health or Google Fit.
Sources of Consumer Health Data
We collect Consumer Health Data:
Directly from you when you enter information into the Clutch Day app
Through your communications with our support team
Through your use of app features that generate personalized outputs based on your inputs
How We Use Consumer Health Data
We collect and use Consumer Health Data for the following purposes:
To provide and operate the Clutch Day app
To generate personalized nutrition, performance, and recovery insights
To maintain, improve, and secure our Services
To respond to user questions and support requests
To analyze app usage and performance using aggregated or de-identified analytics
Consumer Health Data is used solely to provide app functionality and improve user experience. It is not used for advertising, profiling for marketing purposes, or sale to third parties.
Analytics
We may use analytics tools to understand how users interact with the app. Any Consumer Health Data used for analytics is aggregated or de-identified where reasonably possible and is not used to identify individual users for marketing or advertising purposes.
Disclosure of Consumer Health Data
We do not sell Consumer Health Data.
We may disclose Consumer Health Data only in the following limited circumstances:
Service Providers: Trusted vendors that help us operate the app (such as hosting, analytics, or infrastructure providers), under strict confidentiality obligations
Legal Requirements: If required to comply with law, legal process, or governmental request
Business Transactions: In connection with a merger, acquisition, or sale of assets, subject to applicable privacy protections
With Your Consent: When you explicitly authorize us to share information
Data Retention
We retain Consumer Health Data for as long as an account remains active or as reasonably necessary to provide the Services.
You may request deletion of your Consumer Health Data at any time. Upon verified request, we will delete Consumer Health Data from our systems unless retention is required by law.
